Work in Canada

How I can work in Canada

To apply for a work permit in Canada, you will have to go through any of these two programs:

Temporary Foreign worker program (This program requires a Labour Market Impact Assessment (LMIA) to be a beneficiary of this program.)

International Mobility Program (For this program, you don’t need an LMIA)

The Canadian government expects Canadian employers to provide the LMIA to demonstrate that the foreign workers hired are not a threat. In order to demonstrate that foreign workers are not being used to replace existing workers, the Employment and Social Development Canada (ESDC) department must be made aware.

Some work permits are exempt from the general LMIA requirement. If an employer wishes to circumvent the rule, a free trade agreement known as the Canada-United States-Mexico Agreement must be signed (CUSMA). These agreements allow employers to hire foreign workers without the need for an LMIA. If the foreign worker does not have LMIA, the International Mobility Program can help them obtain a work permit. If you don't already have a work permit in Canada, you can apply for post-graduate work permits, working holidays, and open spousal work permits.

LMIA REQUIRED

This work permit will not be issued until the employer has obtained a Labour Market Impact

LMIA EXEMPT

This is for a work permit that does not require the employer or employee to obtain an LMIA before beginning work in Canada.

CUSMA

A Canada-United-States-Mexico Agreement (CUSMA) can be used to bypass the LMIA process, allowing a foreign worker to work in Canada.

INTRA-COMPANY TRANSFERS

When an employer uses the intra-company transfer, foreign workers can move from one of their company's branches outside of Canada to their Canadian office.

BUSINESS VISITORS

If you are referred to as a business visitor in Canada, you will be able to work in Canada without the need for a work permit, but there are some restrictions.

POST-GRADUATION WORK PERMITS

Without a work permit, any international student can work in Canada for up to three years, depending on the years of study.

FAQs

The LMIA is obtained by the Canadian employer when there is a need to employ a foreign worker. The employer must show the government that there is no Canadian fit for the job and that a Canadian is not currently being displaced to provide the vacancy. Acquiring an LMIA takes time as the government ensures no error during the scrutiny.

The Immigration, Refugees and Citizenship Canada (IRCC) department does the work permit allocation. Once you have obtained an LMIA (If it is required), you will need to submit it to the Employment and Social Development Canada department, which, when reviewed, will be forwarded to the IRCC. If the IRCC approves it, you will get the work permit, but if not, you may have to reapply.

The time frame is not fixed as it is based on several factors. One of them is the Labour Market Impact Assessment (If required or not). The work permit stream will also determine how fast you get your work permit.

The work permit documents depend on whether you need an LMIA for the application. If you need it, the following will be submitted to the IRCC alongside the LMIA.

  • Your employment contract
  • The offer letter sent by the company
  • a copy of the LMIA and the Number

Also, the applicants need to prove they will not remain in Canada when their work permit expires. In addition, they need to show they can provide for themselves financially and also not contribute any ills to society.
